  • Directive and decision of the Government - Prime Minister: Temporarily suspend the application of Decree No. 46 on food safety until April 15, 2026.

    Specifically, the Government has decided to temporarily suspend the application of Government Decree No. 46/2026/ND-CP dated January 26, 2026, detailing the implementation of certain provisions and measures for organizing and guiding the implementation of the Law on Food Safety, and Government Resolution No. 66.13/2026/NQ-CP dated January 27, 2026, on the announcement and registration of food products, until April 15, 2026; these documents will resume their effectiveness from April 16, 2026. During the aforementioned temporary suspension period, Government Decree 15/2018/ND-CP dated February 2, 2018, detailing the implementation of certain provisions of the Law on Food Safety, and the regulations and guidelines for its implementation, will remain in effect. This Resolution shall take effect from February 4, 2026. Before April 16, 2026, the Ministries of Health, Agriculture and Environment, Industry and Trade, Finance, relevant ministries and agencies, and People's Committees at all levels shall be responsible for preparing all necessary conditions for the implementation of Decree No. 46/2026/ND-CP and Resolution No. 66.13/2026/NQ-CP. Previously, on February 3, 2026, Prime Minister Pham Minh Chinh signed Official Dispatch No. 08/CD-TTg on focusing on resolving difficulties and obstacles in the organization and implementation of Government Decree No. 46/2026/ND-CP detailing the implementation of some articles and measures to organize and guide the implementation of the Law on Food Safety. This dispatch requested the immediate issuance of guiding documents for the implementation of Decree No. 46 on the inspection of food and imported/exported goods; and the urgent removal of congestion at some border gates to ensure timely customs clearance of food and imported/exported goods. At the regular Government meeting in January 2026 on the afternoon of February 4, Prime Minister Pham Minh Chinh requested the urgent development and issuance of a Government Resolution to resolve current obstacles related to Decree No. 46/2026/ND-CP, emphasizing that this situation should not be allowed to continue. At the same time, the Prime Minister once again reminded ministries and agencies to pay close attention to the requirement of smooth operation, and to include specific transitional provisions when issuing legal documents.
