On July 22, 2026, the Government issued Decree 292/2026/ND-CP detailing some provisions and measures to organize and guide the implementation of the Law on Foreign Trade Management. Among these, the Decree prohibits the import of goods produced through forced labor. Decree 292/2026/ND-CP provides detailed regulations for Clause 1 of Article 10, Clause 1 of Article 28, Clause 1 of Article 31, Articles 38, 39, Clause 2 of Article 40, Articles 41, 42, 43, Clause 4 of Article 44, Clause 3 of Article 110, and Clause 4 of Article 111 of the Law on Foreign Trade Management, and stipulates measures to organize and guide the implementation of the Law on Foreign Trade Management regarding: Firstly, international trade in goods is conducted in the forms of export, import; temporary import, re-export; temporary export, re-import; transshipment; transit and other activities related to international trade in goods as prescribed by law and international treaties to which the Socialist Republic of Vietnam is a party. Secondly, resolving disputes regarding the application of foreign trade management measures. Attached to Decree No. 292/2026/ND-CP are 7 appendices: Appendix I. LIST OF GOODS PROHIBITED FROM TEMPORARILY IMPORTED, RE-EXPORTED, AND TRANSITIONED Appendix VI. LIST OF MILITARY UNIFORM PRODUCTS GRANTED EXPORT PROCESSING LICENSES FOR FOREIGN ARMED FORCES Appendix VII. FORMS LIST OF GOODS PROHIBITED FROM EXPORT AND IMPORT Appendix I of Decree No. 292/2026/ND-CP specifies the list of goods prohibited from export and import. Accordingly, the list of prohibited export goods includes items such as: Cryptographic products used to protect state secrets; Artifacts, antiques, and national treasures as defined by the law on cultural heritage; Publications prohibited from distribution and circulation in Vietnam; Round timber and sawn timber of all kinds from domestic natural forests;... The list of prohibited imported goods includes: Fireworks of all kinds (except maritime safety flares as guided by the Ministry of Construction), sky lanterns, devices that interfere with vehicle speed measuring devices; used consumer goods; used vehicles (including the following groups: a) Textiles, footwear, clothing; b) Electronics, refrigeration, and household appliances; c) Interior decoration items; d) Household goods made of ceramics, earthenware, glass, metal, plastic, rubber, and other materials; e) Bicycles, motorcycles, and motorbikes); used medical equipment; used digital technology products... Specifically, the Decree prohibits the import of products and goods that are exploited, produced, or manufactured wholly or in part by forced labor from enterprises, countries, or territories in accordance with relevant international treaties to which the Socialist Republic of Vietnam is a party. Some goods are included in both the export and import prohibited categories, such as: Weapons, ammunition, explosives; Hazardous chemicals as specified in the List of Prohibited Chemicals and Minerals issued under the Investment Law; Rough diamonds prohibited from import according to the Kimberley Process Certification Regulations; Electronic cigarettes, heated tobacco products. The Decree states: The permission to export and import goods prohibited from export and import, as stipulated in Clause 2, Article 10 of the Law on Foreign Trade Management and Clause 1, Article 28 of Government Decree No. 146/2025/ND-CP on decentralization and delegation of authority in the industrial and commercial sectors, shall be implemented in accordance with Clauses 4 and 5 of this Article. If necessary, the Minister or Head of a Ministry-level agency shall issue a legal document specifying the details of licensing for export and import goods as stipulated in this Clause. Appendix I: LIST OF GOODS PROHIBITED FROM EXPORT AND IMPORT LIST OF GOODS SPECIFIED FOR EXPORT AND IMPORT BY TRADERS The list of goods subject to export and import through the designated trader method is specified in Appendix II attached to this Decree. Specifically, the list of goods designated for export and import by traders includes: Metal blanks used for minting and stamping metal coins; banknote paper; banknote ink; anti-counterfeiting foil pressing machines and anti-counterfeiting foil blanks for use in banknotes, payment checks, and other valuable documents issued and managed by the banking sector; banknote printing machines; metal coin minting and stamping machines (managed by the State Bank of Vietnam); cigarettes and cigars (managed by the Ministry of Industry and Trade). The designation of export and import traders shall be carried out in accordance with the regulations of the competent authorities mentioned above. Appendix II: LIST OF GOODS SPECIFIED FOR EXPORT AND IMPORT BY DESIGNED TRADERS LIST OF GOODS SUBJECT TO EXPORT AND IMPORT LICENSES AND CONDITIONS Goods subject to export and import licenses and conditions shall comply with the provisions of current legal documents and the List of goods subject to export and import licenses and conditions specified in Appendix III of this Decree. Specifically, the list of goods subject to export licenses includes: Chemicals requiring special control; chemicals listed in the Government Decree implementing the Convention on the Prohibition of the Development, Production, Stockpiling, Use and Destruction of Chemical Weapons; hazardous chemicals as specified in the List of Prohibited Chemicals and Minerals issued under the Investment Law; precursors specified in the list of precursors prescribed by the Government (except for precursors managed and permitted by the Ministry of Public Security and the Ministry of Health); explosive precursors, industrial explosives; strategic commercial goods; civilian cryptographic products; raw gold, gold bars, etc. The list of goods imported under the license includes: Chemicals requiring special control; Explosive precursors and industrial explosives; Rough diamonds imported under the Kimberley Process Certification Scheme; Refurbished goods imported under the CPTPP, EVFTA, and UKVFTA agreements; Unmanned aerial vehicles (UAVs), other aircraft, aircraft engines, aircraft propellers, and equipment for UAVs and other aircraft; Fishing vessels imported for fisheries; Vaccines and microorganisms used in veterinary medicine; Cosmetics imported under orders for research and testing; Radioactive materials and nuclear equipment; Raw gold, gold bars, etc. The list of goods subject to export conditions includes: Rice; Chemicals subject to conditions; Petroleum products; Tobacco products; Liquefied petroleum gas, liquefied natural gas and compressed natural gas; Minerals (excluding minerals used as construction materials); Minerals used as construction materials; Aquatic products belonging to the list of aquatic species subject to export conditions; Unmanned aerial vehicles, other aircraft, aircraft engines, aircraft propellers and equipment for unmanned aerial vehicles and other aircraft; Signal jamming equipment; Film. The list of goods subject to import conditions includes: Conditional chemicals; Petroleum products; Tobacco raw materials, cigarette paper, machinery and equipment for the tobacco industry; Alcohol; Liquefied petroleum gas, liquefied natural gas and compressed natural gas; Automobiles; Imported fishing vessels for fisheries; Veterinary medicines; Scrap materials; Cosmetics (excluding cosmetics imported for research and testing)... Ministers and heads of ministerial-level agencies shall issue or submit to competent authorities for issuance detailed regulations on the procedures for granting export and import licenses and shall carry out the licensing process in accordance with the regulations. Based on the operational objectives in each period, the Minister of Industry and Trade shall regulate the application of automatic export licenses and automatic import licenses for certain types of goods. Appendix III: LIST OF GOODS SUBJECT TO EXPORT AND IMPORT LICENSES AND CONDITIONS LIST OF GOODS AND AUTHORITY FOR MANAGING CERTIFICATES OF FREE CIRCULATION (CFS) Appendix IV of Decree 292/2026/ND-CP stipulates the list of goods and the authority to manage Certificates of Free Sale (CFS), including: Functional foods, fortified foods, food supplements, food additives, drinking water, domestic water, natural mineral water; cigarettes; chemicals, insecticides, disinfectants used in the household and medical fields; medicines, cosmetics; medical equipment (managed by the Ministry of Health); chemicals, industrial explosives; machinery and equipment with strict requirements for occupational safety under the state management of the Ministry of Industry and Trade; consumer industrial products, food industry and other processing industries as prescribed by law (managed by the Ministry of Industry and Trade); various types of vehicles, construction materials (managed by the Ministry of Construction); textbooks, curricula, teacher's guides; Teaching equipment and toys for children in the field of education and training fall under the state management scope of the ministry as prescribed by law (managed by the Ministry of Education and Training).... Appendix IV: LIST OF GOODS AND AUTHORITY FOR MANAGING CERTIFICATES OF FREE CIRCULATION (CFS) Regulations regarding CFS (Certificate of Free Sale) for imported goods: If necessary, to ensure effective management, Ministries and ministerial-level agencies, based on their management authority as stipulated in Appendix IV of this Decree, shall submit to the Government for promulgation a document stipulating that imported goods must submit a Certificate of Free Sale (CFS) to the competent authority and publish a detailed list of goods along with their HS codes. Ministries and ministerial-level agencies with management authority shall regulate or report to competent authorities the minimum information required on import CFSs, or prescribe the CFS form for imported goods. Ministries and ministerial-level agencies with the authority to manage regulations shall specify the cases in which a Certificate of Free Sale (CFS) can be applied to multiple shipments; and specify the validity period for accepted import CFSs in cases where the CFS does not specify a validity period. Regulations regarding CFS (Certificate of Free Sale) for exported goods: The provincial People's Committee is the competent authority to issue Certificates of Free Sale (CFS) for exported goods according to the following regulations: a) Upon request from the exporting trader for the issuance of a CFS for the goods; b) The goods have declared standards, product declaration forms, or registration certificates for circulation as prescribed by current law. A Certificate of Free Sale (CFS) issued for exported goods is valid for 5 years from the date of issuance, unless otherwise stipulated by applicable law. The issuing authority shall revoke a CFS issued in the following cases: a) The exporting trader falsifies documents; b) The CFS is issued for goods that do not conform to the applicable declared standards. LIST OF GOODS PROHIBITED FROM TEMPORARY IMPORT, RE-EXPORT, AND TRANSIT The list of goods prohibited from temporary import, re-export, and transshipment is specified in Appendix V attached to this Decree. Appendix V: LIST OF GOODS PROHIBITED FROM TEMPORARY IMPORT, RE-EXPORT, AND TRANSIT The above-mentioned list of goods does not apply to cases of goods traded through re-export in which the goods are transported directly from the exporting country to the importing country, without passing through Vietnamese customs checkpoints. In order to prevent environmental pollution, disease outbreaks, harm to human health and life, illegal transshipment, and the risk of trade fraud, the Minister of Industry and Trade shall decide on specific goods to be temporarily suspended from import, re-export, and transshipment, and publicly announce the list along with the HS codes of the goods. LIST OF MILITARY UNIFORM PRODUCTS GRANTED EXPORT PROCESSING LICENSES FOR FOREIGN ARMED FORCES Appendix VI specifies the list of military uniform products for which processing licenses for export to foreign armed forces are granted. The military uniforms referred to in this Article are understood to be the uniforms of military personnel belonging to foreign armed forces, manufactured according to unified designs and specifications, and worn in accordance with the regulations of those foreign armed forces. Textile products included in this List, but not military uniforms for foreign armed forces, are not subject to the regulations in this Article. The provincial People's Committee is the competent authority to issue permits for the processing of military uniforms, based on consultations with the Ministry of National Defense and the Ministry of Public Security. Military uniforms manufactured for export to foreign armed forces are not permitted for consumption in Vietnam. The raw materials and accessories used in the processing of military uniforms for export to foreign armed forces are subject to customs supervision from the time of import until the finished uniforms are actually exported from Vietnam. In addition to complying with the regulations in this Article, the processing of military uniforms must also comply with the regulations on processing goods with foreign elements as stipulated in Chapter V of this Decree. Appendix VI: LIST OF MILITARY UNIFORM PRODUCTS GRANTED EXPORT PROCESSING LICENSES FOR FOREIGN ARMED FORCES Forms In addition to the categories mentioned above, Appendix VII specifies the following forms: Application for export/import of prohibited goods/goods temporarily suspended from export/import; Application for a Certificate of Free Sale (CFS); Sample Certificate of Free Sale for exported goods; Application for a temporary import/re-export business license;...
